This waiver applies to any athlete who uses CortexFlex to plan, record, or follow physical training. When an athlete is under 18, a parent or legal guardian agrees to it on the athlete's behalf.
1. Nature of the activity
CortexFlex provides training plans, workout tracking, and coaching tools for strength, conditioning, and sport. Physical training carries inherent risks, including muscle strains, sprains, joint injury, and, in rare cases, more serious injury. These risks cannot be eliminated regardless of the care taken.
2. Assumption of risk
The athlete (and, for a minor, their parent or guardian) understands and voluntarily accepts these risks. The athlete is responsible for training within their own ability, using appropriate equipment and supervision, warming up, and stopping if they feel pain, dizziness, or unusual discomfort.
3. Not medical advice
CortexFlex is not a medical provider. Training plans and any health-related figures shown in the app are general information, not medical advice, diagnosis, or treatment. Consult a qualified physician before starting or significantly changing a training program, especially if the athlete has an existing medical condition, injury, or symptom.
4. Coach content
Where a coach assigns workouts or feedback through CortexFlex, that content is the coach's, not CortexFlex's. CortexFlex does not supervise training sessions and is not responsible for a coach's instructions.
5. Release
To the fullest extent permitted by law, the athlete (and, for a minor, their parent or guardian) releases CortexFlex, its staff, and its contractors from liability for injury, loss, or damage arising from the athlete's use of the Services or participation in training organized through them, except to the extent caused by CortexFlex's gross negligence or willful misconduct.
6. Parent / guardian acknowledgement
By consenting, the parent or guardian confirms that they:
- are the athlete's parent or legal guardian, with authority to agree on their behalf;
- have read and agree to this waiver and the Terms of Service and Privacy Policy on the athlete's behalf;
- consent to the athlete's use of CortexFlex and to CortexFlex processing the athlete's training and account data as described in the Privacy Policy.
Consent can be withdrawn at any time using the link in the confirmation email, which will suspend the athlete's account.
